The Victorian Government will introduce a Tobacco Business Licensing Scheme to regulate tobacco sales and address the illicit tobacco market. If you sell tobacco products in Victoria, a licence will be required.
Key Dates:
- 1 July 2025 – Licence applications open
- 1 July 2026 – Licence required to sell tobacco (offences and penalties apply)
What’s changing?
- It will be illegal to sell tobacco without a licence
- Suitability of sellers will be assessed before a licence is granted
- Licence conditions may apply to storage, display, and sale practices
- Government authorities will have new enforcement powers
Who will be affected?
All retailers and wholesalers selling tobacco products (including cigarettes, cigars, and loose-leaf tobacco) in Victoria.
Note: E-cigarettes and vaping products are excluded — these are now banned under federal law.

- Licence fees and specific requirements are still being finalised
- A 12-month transition period allows time to comply before enforcement begins
- The scheme aligns with broader national reforms to tobacco regulation
What this means for Independent Retailers
From July 2025, businesses must apply for and maintain a licence to legally sell tobacco. The scheme is expected to introduce new administrative and compliance obligations.
From July 2026, selling tobacco without a valid licence will be an offence.
