To help your business stay compliant with the Tobacco and Other Smoking Products Act 1998, we’ve summarised the latest regulatory updates from Queensland Health into key action points.
Licence Renewal
- Licences are valid for 1 year.
- Renewal reminders will be sent but check anytime via Public Health Connect.
- Renew before expiry to continue trading while your application is processed.

Change of Ownership
- Sold your business? You must surrender your licence within 14 days of settlement.
- Licences cannot be transferred.
- New owners must apply for a new licence.

Employee Training
- You must train employees on smoking product laws.
- Use the updated Training Acknowledgment Form — signed copies must be kept on file.
- Download form and info or call QLD Health on 13 74 68 for hard copies.
Under 18s Cannot Sell
- Staff under 18 must not handle or sell smoking products.
- Small businesses (<20 staff) have until 1 Sept 2025 to comply.
- Call QLD Govt on 13 74 68 to get posters and fact sheets about the rules for employing staff under 18.
Vaping Products Are Banned in Retail
- Only pharmacies can supply vapes under strict conditions.
- No other retail setting can legally sell any vape products, even nicotine-free.
- Severe penalties apply for non-compliance.

National Tobacco Product Requirements (from 1 April 2025)
- New packaging and content rules now apply.
- You may sell or return old stock until 30 June 2025.
- Full compliance starts 1 July 2025.
